Terms of Use

These Terms of Use (“Terms”) constitute a legally binding agreement between you (“you” or “your”) and Théo Grelet (“Nonna,” “we,” “us,” or “our”), governing your access to and use of the Nonna mobile application and related services (collectively, the “Services”).

By creating an account or using the Services, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the Services.

We may update these Terms from time to time. If we make material changes, we will notify you through the app or by email. Your continued use of the Services after the effective date of any update constitutes acceptance of the revised Terms.

1. Eligibility

You must be at least 18 years of age (or the equivalent minimum age in your jurisdiction) to create an account and use the Services. By registering, you represent and warrant that you meet this requirement. If you are a parent or guardian, you may authorize a minor under your supervision to use the Services, and you accept full responsibility for their activity.

2. Account Registration

You may create an account using Sign in with Apple or by providing an email address and password. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You agree to provide accurate and complete information during registration and to update it as necessary. If you become aware of any unauthorized access to your account, you must notify us immediately at support@trynonna.app.

We reserve the right to suspend or terminate any account that we reasonably believe violates these Terms.

3. Description of the Services

Nonna is a mobile application that converts short-form cooking videos from supported platforms (currently Instagram Reels and TikTok) into structured, written recipes. The Services include:

• Recipe import: You share a public video link, and Nonna extracts audio, transcribes it, and uses artificial intelligence to generate a structured recipe with ingredients and steps.
• Manual recipe creation: You can create recipes manually at any time using the built-in editor, without using import credits.
• Recipe management: You can view, edit, organize, and store your recipes within the app.

Nonna uses third-party AI services (including OpenAI, and depending on availability, Anthropic, Mistral AI, and Google Cloud AI) to process video content and generate recipes. AI-generated recipes are automated outputs and may contain errors, omissions, or inaccuracies. You are responsible for reviewing any recipe before use. See Section 10 (Disclaimers) for more detail.

4. Supported Platforms and Content

4.1 Supported sources

The recipe import feature currently supports public video links from Instagram Reels and TikTok only. We may add or remove supported platforms at any time. Attempting to import content from unsupported platforms will be declined.

4.2 Third-party content

When you submit a video link, Nonna temporarily accesses and processes the associated video solely to generate a recipe for your personal use. You are responsible for ensuring that you have the right to use any content you submit. Nonna does not store, redistribute, or make the original video content available to other users.

You acknowledge that the original video content is owned by its creator and/or the hosting platform, and that the recipe generated by Nonna is a derivative interpretation of that content. The generated recipe does not transfer any rights in the original video to you or to us.

4.3 Acceptable use

You agree not to:

• Submit content that you know to be infringing, illegal, or harmful.
• Use the Services for any purpose other than personal, non-commercial recipe management.
• Attempt to reverse-engineer, decompile, or extract the source code of the app or the backend pipeline.
• Use automated tools, bots, or scripts to interact with the Services.
• Create multiple accounts to circumvent credit limits, rate limits, or other restrictions.
• Interfere with or disrupt the integrity or performance of the Services.
• Resell, sublicense, or redistribute recipes generated by the Services in bulk or for commercial purposes.

5. Credits and Free Tier

5.1 Free credits

Upon creating an account, you receive 5 free import credits. Each credit allows you to import one recipe from a supported platform. Credits are non-transferable and have no monetary value.

5.2 What consumes a credit

Only recipe imports from social media platforms consume credits. Manual recipe creation, viewing recipes, editing recipes, and organizing your collection are always free, regardless of your credit balance or subscription status.

5.3 When credits reach zero

When your free credits are exhausted, the import feature is disabled until you subscribe to a Premium plan. All other features remain fully accessible.

6. Premium Subscriptions

6.1 Plans and pricing

Nonna offers Premium subscription plans that provide unlimited recipe imports and additional features. Current pricing is displayed in the app at the time of purchase. We offer:

• Founding Member pricing: Available to early subscribers during a limited introductory period. Founding Members retain their pricing for as long as their subscription remains active and uninterrupted.
• Standard pricing: Available after the Founding Member period ends.

Specific plan details, including monthly and annual options, are presented in the app before purchase.

6.2 Billing and renewal

Premium subscriptions are billed through Apple’s in-app purchase system. By subscribing, you agree to Apple’s terms for in-app purchases and subscriptions.

• Subscriptions renew automatically at the end of each billing period (monthly or annually) unless you cancel at least 24 hours before the end of the current period.
• Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.
• You can manage your subscription and turn off auto-renewal at any time in your Apple ID account settings.

6.3 Founding Member pricing

Founding Member pricing is a limited-time offer. If you cancel your Founding Member subscription and later resubscribe, the Founding Member rate is not guaranteed and may no longer be available. We will communicate clearly in the app if the Founding Member offer is ending.

6.4 Fair use

Premium subscriptions include a fair-use allowance of up to 50 imports per month. This limit exists to ensure service quality and availability for all users. If you consistently exceed this allowance, we may contact you to discuss your usage.

6.5 Refunds

Refunds for subscriptions are handled by Apple in accordance with Apple’s refund policies. We do not process refunds directly. To request a refund, visit Apple’s support page or contact Apple directly.

6.6 Price changes

We may change subscription pricing at any time. Any price change will take effect at the start of your next billing period after the change. Apple will notify you in advance of any price increase, and your continued subscription after that notification constitutes acceptance of the new price. If you do not agree with a price change, you may cancel your subscription before the new price takes effect.

7. User Content

7.1 Your content

“User Content” means any content you create, edit, or input within the Services, including manually created recipes, edits to imported recipes, cookbook names, and any other text or data you provide.

You retain ownership of your User Content. By using the Services, you grant us a limited, non-exclusive, worldwide, royalty-free license to store, process, and display your User Content solely to provide and improve the Services. This license terminates when you delete your content or your account.

7.2 AI-generated content

Recipes generated by the AI pipeline are produced based on the audio content of the video you submitted. You may use, edit, and store AI-generated recipes for your personal, non-commercial use. We do not claim ownership of AI-generated recipes delivered to you.

You acknowledge that AI-generated recipes may be similar or identical to recipes generated for other users who submitted the same or similar video content.

7.3 Prohibited content

You may not use the Services to store or distribute content that is illegal, defamatory, obscene, or that infringes on the rights of any third party.

8. Intellectual Property

8.1 Our intellectual property

The Nonna app, including its design, branding, logos, user interface, software, and AI pipeline, is owned by us and protected by applicable intellectual property laws. These Terms do not grant you any right, title, or interest in our intellectual property, except for the limited license to use the Services as described herein.

8.2 Feedback

If you provide us with suggestions, ideas, or feedback about the Services (“Feedback”), you grant us an unrestricted, irrevocable, worldwide, royalty-free license to use, modify, and incorporate that Feedback into the Services without any obligation to you.

9. Privacy

Your use of the Services is also governed by our Privacy Notice, available at https://trynonna.app/privacy. By using the Services, you acknowledge that you have read and understood the Privacy Notice.

10. Disclaimers

10.1 AI accuracy

Nonna uses artificial intelligence to generate recipes from video content. AI-generated recipes are provided “as is” and may contain errors, including incorrect ingredient quantities, missing steps, allergen omissions, or nutritional inaccuracies. You are solely responsible for reviewing and verifying any recipe before preparation or consumption. Nonna is not a substitute for professional nutritional, dietary, or medical advice.

10.2 Allergens and dietary requirements

Nonna does not guarantee the detection or accurate listing of allergens, dietary restrictions, or nutritional information. If you have food allergies, intolerances, or specific dietary needs, you must independently verify all ingredients and preparation methods before use.

10.3 Service availability

The Services depend on third-party platforms (Instagram, TikTok) and AI providers (OpenAI and others). We do not guarantee that the import feature will function at all times. If a third-party platform changes its policies, availability, or technical infrastructure, the import feature may be degraded or unavailable, temporarily or permanently. We are not liable for any interruption caused by third-party changes.

10.4 General disclaimer

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL NONNA, ITS OWNER, AFFILIATES, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICES, REGARDLESS OF THE CAUSE OF ACTION OR THE THEORY OF LIABILITY.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL AGGREGATE LIABILITY ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) FIFTY US DOLLARS ($50.00).

NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW, INCLUDING LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE, FRAUD, OR FRAUDULENT MISREPRESENTATION.

12. Indemnification

You agree to indemnify, defend, and hold harmless Nonna and its owner from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any third-party right, including intellectual property or privacy rights; or (d) any content you submit through the Services.

13. Account Termination

13.1 By you

You may delete your account at any time through the app’s account settings. Upon deletion, we will remove your personal information and recipe data from our active databases in accordance with our Privacy Notice. Active subscriptions must be cancelled separately through your Apple ID account settings; deleting your Nonna account does not automatically cancel your Apple subscription.

13.2 By us

We may suspend or terminate your account at any time if we reasonably believe that you have violated these Terms, engaged in abusive or fraudulent behavior, or if required by law. Where possible, we will notify you in advance and provide a reason for the action.

13.3 Effect of termination

Upon termination, your right to use the Services ceases immediately. Sections that by their nature should survive termination will continue to apply, including Sections 7 (User Content), 8 (Intellectual Property), 10 (Disclaimers), 11 (Limitation of Liability), 12 (Indemnification), 14 (Governing Law), and 15 (Dispute Resolution).

14. Governing Law

These Terms are governed by and construed in accordance with the laws of France, without regard to its conflict-of-law principles.

If you are a consumer resident in the European Union or the United Kingdom, you also benefit from any mandatory provisions of the consumer protection laws of your country of residence. Nothing in these Terms affects your statutory rights as a consumer that cannot be waived or limited by contract.

15. Dispute Resolution

15.1 Informal resolution

Before initiating any formal proceedings, you agree to contact us at support@trynonna.app and attempt to resolve the dispute informally for at least 30 days.

15.2 Jurisdiction

If informal resolution is unsuccessful, any dispute arising from or relating to these Terms shall be submitted to the exclusive jurisdiction of the courts of Paris, France, except where mandatory consumer protection laws in your jurisdiction grant you the right to bring proceedings in a different forum.

15.3 EU consumers

If you are a consumer resident in the European Union, you may also use the European Commission’s Online Dispute Resolution platform, available at https://ec.europa.eu/consumers/odr.

16. General Provisions

Entire agreement. These Terms, together with the Privacy Notice, constitute the entire agreement between you and us regarding your use of the Services and supersede all prior agreements.

Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Waiver. Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

Assignment. You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.

Force majeure. We are not liable for any failure or delay in performing our obligations under these Terms due to causes beyond our reasonable control, including but not limited to natural disasters, government actions, internet or infrastructure failures, or third-party service disruptions.
